Please read these terms carefully before using MoitorDMARC

Plain-English Summary: By using MonitorDMARC you agree to these terms. We offer a subscription service that monitors DMARC, SPF, DKIM, and BIMI records for your domains. You own your data. We protect it. You can cancel anytime. These terms are governed by the laws of the Commonwealth of Virginia, USA.

Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and MonitorDMARC ("MonitorDMARC," "we," "us," or "our"), a service operated from the Commonwealth of Virginia, USA.
By creating an account, starting a free trial, or using any part of the MonitorDMARC platform (available at monitordmarc.com and app.monitordmarc.com), you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
If you are using MonitorDMARC on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not have such authority, or if you disagree with any part of these Terms, you must not use the service.

Service Description
MonitorDMARC is a cloud-based email security monitoring platform. The service provides:
- DMARC Aggregate Report (RUA) Processing — We accept, parse, and display DMARC aggregate reports sent by email providers on your behalf.
- DMARC Forensic Report (RUF) Processing — We accept and display individual failure reports generated when emails fail DMARC authentication.
- DNS Record Monitoring — We monitor your SPF, DKIM, DMARC, and BIMI DNS records and alert you to any unauthorized or unexpected changes.
- Dashboard & Reporting — We present email authentication data through an easy-to-read web dashboard.
- Alerts & Notifications — We send email alerts when issues or changes are detected.
Feature availability may vary by subscription plan. We reserve the right to modify, update, or discontinue features with reasonable notice to active subscribers.

Eligibility
To use MonitorDMARC you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
- Have the legal authority to enter into a binding contract.
- Not be a person or entity barred from receiving services under the laws of the United States or any other applicable jurisdiction.
- Use the service only for lawful business purposes related to email security and domain monitoring.

Accounts & Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and complete.
- Keep your password confidential and not share it with any third party.
- Notify us immediately at support@monitordmarc.com if you suspect any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account credentials.
MonitorDMARC reserves the right to refuse registration or cancel accounts at our discretion, including where we believe the information provided is inaccurate or where usage violates these Terms.

Subscriptions & Billing
MonitorDMARC is offered under the following paid subscription plans:

Billing & Payment. Payments are processed securely through Stripe. By subscribing, you authorize MonitorDMARC to charge your payment method on a recurring basis at the frequency you selected (monthly or annually). All prices are in US Dollars and do not include applicable taxes.
Upgrades & Downgrades. You may change your plan at any time from your account settings. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of your next billing cycle.
Email Volume Limits. Each plan includes a monthly email volume limit. We will notify you at 90% of your limit. A 20% grace buffer is provided before monitoring is paused. If you consistently exceed your plan's limits, we may require you to upgrade.
Overdue Payments. If payment cannot be collected, we may suspend your account after providing reasonable notice. Accounts suspended for non-payment may be permanently deleted after 30 days.
Refunds. Subscription fees are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 14 days at support@monitordmarc.com.

Free Trial
MonitorDMARC offers a 14-day free trial with no credit card required. During the trial you will have access to Starter plan features, including the ability to monitor up to 2 domains.
At the end of your trial, your account will not be automatically charged. To continue monitoring after the trial period, you must select a paid plan and provide a valid payment method. Inactive trial accounts and their associated data may be deleted after 30 days.
MonitorDMARC reserves the right to modify or discontinue the free trial offer at any time without notice to prospective users (existing active trials will not be affected).

Acceptable Use
You agree to use MonitorDMARC only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. You must not:
- Add domains to your account that you do not own or have explicit written authorization to monitor.
- Attempt to gain unauthorized access to any part of our systems, servers, or databases.
- Interfere with or disrupt the integrity or performance of the service or the data it contains.
- Use the service to engage in phishing, email spoofing, or any other fraudulent or deceptive activities.
- Reverse engineer, decompile, or otherwise attempt to extract the source code of our platform.
- Resell or sublicense access to MonitorDMARC without our express written consent.
- Use automated tools, bots, or scrapers to access the service in a manner that places excessive load on our infrastructure.
- Violate any applicable laws regarding data privacy or electronic communications.
We reserve the right to investigate suspected violations and, in our sole discretion, to suspend or terminate accounts found to be in violation of this policy without prior notice or refund.

Your Data
Ownership. You retain full ownership of all data you submit to MonitorDMARC, including your domain information, DMARC reports, and account settings. MonitorDMARC claims no ownership over your data.
License to Process. By using the service, you grant MonitorDMARC a limited, non-exclusive license to receive, store, and process your data solely for the purpose of providing and improving the service.
Data Retention. We retain your DMARC report data for the duration defined by your plan:
- Starter — 1 year
- Professional — 2 years
- Business — 3 years
- Enterprise — Custom (as agreed)
Account Cancellation. Upon cancellation, your account data will be retained for 30 days to allow for reactivation. After 30 days, all data is permanently deleted and cannot be recovered.
Security. We implement commercially reasonable technical and organizational measures to protect your data against unauthorized access, loss, or disclosure. However, no internet-based service can guarantee absolute security. You are responsible for maintaining the security of your account credentials.
DMARC Report Content. DMARC reports may contain email metadata, IP addresses, and domain information. By directing reports to MonitorDMARC's email addresses, you acknowledge that this information will be processed and stored by us in accordance with our Privacy Policy.

Intellectual Property
The MonitorDMARC platform, including its software, design, logos, trademarks, and all content created by us, is the exclusive property of MonitorDMARC and is protected by copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for your internal business purposes. Nothing in these Terms transfers ownership of any MonitorDMARC intellectual property to you.
The MonitorDMARC name, logo, and tagline "Delicious DMARC — Email Security for Everyone" are trademarks of MonitorDMARC. You may not use them without our prior written consent.

Uptime & Service Availability
We strive to provide reliable and continuous service. Scheduled maintenance will be communicated in advance where practicable. Enterprise plan subscribers are entitled to an uptime SLA as specified in their plan details (99.9% for Enterprise Shared; 99.95% for Enterprise Dedicated).
Standard plan (Starter, Professional, Business) subscribers are not entitled to a specific uptime SLA, though we make commercially reasonable efforts to maximize availability. We are not liable for service interruptions resulting from:
- Scheduled or emergency maintenance
- Force majeure events (natural disasters, power outages, etc.)
- Third-party service failures (including internet infrastructure)
- Actions or inactions of your ISP or DNS provider

Confidentiality
Each party agrees to keep the other's confidential information strictly confidential and not to disclose it to any third party without prior written consent, except as required by law. MonitorDMARC treats all customer data and account information as confidential.
We will never sell your data to third parties or use it for advertising purposes. Aggregate, anonymized usage statistics may be used internally to improve the service.

Disclaimers
MonitorDMARC is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:
- Implied warranties of merchantability and fitness for a particular purpose
- Any warranty that the service will be uninterrupted, error-free, or completely secure
- Any warranty that the service will meet your specific requirements
Important: MonitorDMARC monitors and reports on your email authentication configuration. We do not guarantee that using our service will prevent all email deliverability issues, spoofing, or phishing attacks. Email security involves many factors beyond DMARC monitoring. You remain responsible for your own DNS configuration, email infrastructure, and security posture.

Limitation of Liability
To the maximum extent permitted by applicable law, MonitorDMARC's total aggregate liability to you for any claims arising out of or relating to these Terms or the service, whether in contract, tort, or otherwise, shall not exceed the total amount you paid to MonitorDMARC in the three (3) months immediately preceding the event giving rise to the claim.
In no event shall MonitorDMARC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

Indemnification
You agree to defend, indemnify, and hold harmless MonitorDMARC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the service in violation of these Terms
- Your violation of any applicable law or third-party rights
- Domains or data you submit to the service that infringe on the rights of any third party

Termination
Cancellation by You. You may cancel your subscription at any time through your account settings. Your access will continue until the end of the current billing period, after which your account will be downgraded or closed. No refunds are issued for partial billing periods.
Termination by MonitorDMARC. We may suspend or terminate your account at any time with or without notice if:
- You violate these Terms or our Acceptable Use Policy
- Your payment method fails and is not updated within a reasonable period
- We are required to do so by law
- We determine, in our sole discretion, that continued service poses a risk to other users or our infrastructure
Effect of Termination. Upon termination, your right to access the service ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Send an email notification to the address registered on your account at least 14 days before the changes take effect
Your continued use of MonitorDMARC after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before they take effect.

Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of MonitorDMARC shall first be attempted to be resolved informally by contacting us at support@monitordmarc.com. We will make good-faith efforts to resolve any concerns within 30 days.
If informal resolution fails, both parties agree that any legal action shall be brought exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of those courts.
